The Counterclaim
In cases such as road traffic accidents both parties suffer damage and have a potential claim against each other. In these cases, the claimant is merely the person who gets the claim form in first.
A person who a claim is made against can make a claim against the claimant by starting a counterclaim/part 20 claim.
1. File counterclaim with their defence by filling in the counterclaim section on the defence form/Form N9B along with the defence itself and pay a fee in the same way you would do for a claim.
2. Ask the Court’s permission if they want to make a counterclaim at a later stage in proceedings
