The Claim

Put simply the basic process of starting, or ‘issuing’, a claim involves the following:-

A. Filling out the initial court form known as the Claim Form or N1, and

B.Explaining what is being claimed in further detail on the Claim Form or on a separate document called the Particulars of Claim, and

C. Pay the Court Fee. The claim form is served by the Court on the Defendant unless the Claimant specifically asks the Court to serve it himself.

Unless a Claimant (person who is making the Claim) applies to the Court for more time, they must serve the Defendant with the Claim Form and Particulars of Claim within four months of issue/starting the claim.
