Final Hearing/Trial

Final Preparation:-

A. File and serve documents relied on 14 days before the hearing. Usually the Court will order this anyway.

B. Prepare and serve witness statements 14 days before the hearing. Courts do not often order this in small claims and are used to statements being brought on the day of the hearing but it is good practice to try to make sure statements are sent in advance to the other side.

C.Pay the hearing fee

D. Decide whether to attend the hearing. Courts are allowed to consider a party’s evidence if they do not attend the hearing but only if they file a note at least 7 days before saying they will not attend and that they have served all documents filed with the Court. However, it always makes for a far stronger case if a party attends Court.
