Applications

It is unusual to need to make applications in small claims but there are circumstances such as a request to postpone the hearing or enter summary judgement where an application might be necessary.

Although not necessary, it is advisable to use the standard application N244 form as the rules on what is required in an application notice are complex.

An application notice must be served on the other party at least 3 days before the application is heard by the Court.

Applications can be made without notice but this in rare situations such as that of ‘exceptional urgency’ so will not be discussed here.
