Allocation Questionnaires

This is a form, sent by the Court, to decide whether a claim should be dealt with on the small claims, fast or multi track, plan how long the case will take and decide where in the Country the case should be heard.

The parties fill in questions on the form (either an N149 or N150 form) which the Court can then use to allocate the case.

To fill in the questionnaire you need to tell the Court if you need more time to settle, where the case should be heard, what track the case should be on and whether any witnesses or experts are needed.

The rules on allocation are complex but a rule of thumb is that if a case is less than £5 000.00 for anything other than personal injury, or in the case of personal injury less than £1000.00.

The allocation fee is paid by the Claimant unless the claim is dropped and case continues on counterclaim alone, when it is paid by the Defendant.

The fee is due when returning the questionnaire but when allocation questionnaires are not required it is due 14 days after the notice of allocation to a track is sent by the Court.

The Court will give the parties some time to settle a claim before sending out allocation questionnaire but the parties have only 14 days from receipt to file the forms at the Court.
